Welcome to Tekalelo Creative Limited (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our website and our services, including but not limited to virtual assistance, business development, marketing support, content creation, videography, and photography.
By accessing or using our website or services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.
1. Definitions
Client: Any person or entity who engages Tekalelo Creative Limited for services.
Services: Any offering by Tekalelo Creative Limited, including monthly support, or project-based media production.
Website: The online platform located at www.tekalelocreative.com
2. Scope of Services
Tekalelo Creative Limited offers:
Ongoing virtual assistant services, including marketing, project management, content creation, and business development.
One-off photography and videography services.
All services are subject to specific agreements and project scopes.
3. Booking & Payment
Monthly services are billed in GBP at the end of each month, based on the actual number of hours worked at a rate agreed upon in advance. However, payment will be transacted in Zambian Kwacha.
One-off projects are invoiced per project, with payment due within 14 days of invoice.
Late payments may incur interest charges of 5% per 14-day period after the due date.
4. Client Responsibilities
Clients agree to:
Provide accurate and timely information, materials, or approvals necessary to complete the work.
Communicate clearly regarding deadlines, scope changes, or deliverables.
Make payments as per the agreed timeline.
5. Intellectual Property
For monthly support or project-based services, all final deliverables become the Client’s property once full payment is received.
Tekalelo Creative Limited retains the right to showcase non-confidential work in its portfolio unless the Client requests otherwise in writing.
6. Limitation of Liability
To the fullest extent permitted by Zambian law, Tekalelo Creative Limited is not liable for:
Any indirect or consequential losses (e.g., lost profits, business disruption).
Delays or non-performance due to factors beyond our control, including force majeure events or third-party tool failures.
7. Cancellation, Termination & Refunds
Monthly service agreements may be terminated by either party with 30 days' written notice.
For one-off services, cancellation fees may apply if a booking is cancelled within 48 hours of a confirmed shoot.
Due to the nature of our services, all payments made are non-refundable once work has commenced.
In exceptional circumstances (e.g. duplicate payments or billing errors), refunds may be considered at our discretion.
8. Website Content & Use
All content on this website is the property of Tekalelo Creative Limited and may not be reproduced without permission.
Users must not use the website for any unlawful or unauthorized purpose.
9. Dispute Resolution
Any disputes will first be resolved through mediation in Zambia. If mediation fails, the dispute may be referred to a court of competent jurisdiction in Zambia.
10. Governing Law
These Terms are governed by and interpreted in accordance with the laws of the Republic of Zambia.
